We write terms and contracts with provisions that benefit and protect your sellers with simple and effective recourse. Most often we include clauses stating that failed payments result in the property reverting directly to your seller without the process of foreclosure. So, in most cases, your seller would walk away with all of the money paid to that point AND the property to re-sell. 

Creative Financing Is More Generous Than Institutional Lending

In a conventional foreclosure, the financing party is required to take the property, settle the debt, and pay out any excess equity to the delinquent party. Creative Finance is more flexible, and we can write contracts that are more favorable to your seller in the case of any delinquency. 

Unlike institutional financing contracts, your seller would NOT be required to return any equity to us in excess of our outstanding debt. Your sellers would keep everything, and they could turn around and sell the property again.
